4. Nature of Our Guidance

Healing by Nutrition shares personal experience and practical educational guidance relating to nutrition, food choices, exercise and lifestyle.

We are not medical practitioners or clinical nutrition professionals. Our services do not constitute medical advice, diagnosis, treatment, physiotherapy, psychological treatment or other regulated healthcare services.

Our plans are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Information on our website and guidance provided through our programmes are not substitutes for advice from a qualified healthcare professional.

If you have a medical condition, take prescribed medication, have an injury, are pregnant or have another health concern that could affect your nutrition or exercise, consult an appropriate healthcare professional before making relevant changes.

Do not stop, reduce or change prescribed medication or medical treatment based on information supplied by Healing by Nutrition.

You remain responsible for seeking appropriate professional advice when necessary.

5. Personalised Plans and Client Information

Our personalised plans are prepared using information you provide, including your food preferences, eating habits, exercise experience, goals and other information relevant to the service.

You are responsible for providing accurate and sufficiently complete information for the preparation of your plan.

If you identify an error or omission in the information you have supplied, please contact us as soon as possible.

Our recommendations are based on the information available to us at the time of preparation. We cannot take account of circumstances that have not been disclosed or that arise after a plan has been prepared.

If your circumstances change significantly, you should consider whether your existing plan remains suitable and seek qualified professional advice where appropriate.

A personalised plan is not a guarantee of a particular health, weight-loss, strength or fitness outcome.

6. Enquiries and Formation of a Contract

Submitting an enquiry through our website does not, by itself, constitute a purchase or create an obligation to pay.

After receiving your enquiry, we may contact you to answer questions, clarify your requirements and confirm which service you wish to purchase.

Before you commit to a purchase, we will confirm the service, its applicable price, the payment arrangements and the expected delivery or commencement arrangements. We will also provide the information required by applicable law, including information about your statutory cancellation and withdrawal rights.

A contract is formed when we have accepted your order and the service and applicable price have been agreed. The applicable payment arrangements and any relevant start date will be confirmed as part of the agreement. Unless otherwise agreed, payment must be received before preparation of your plans begins or your coaching programme starts.

We will provide confirmation of the contract and the relevant contractual information in a form you can retain, such as by email.

Where a service is purchased online or through another distance-selling method, applicable statutory requirements for distance contracts will apply.

Nothing in this section removes any statutory rights you may have as a consumer.

7. Prices, Taxes and Payment

The price applicable to your purchase will be confirmed before you enter into the contract.

Prices displayed in US dollars are payable in that currency unless otherwise agreed in writing. Your bank or payment provider may apply its own exchange rate or charges.

Any applicable taxes, including VAT where required, will be disclosed before purchase. Consumer prices will include applicable taxes where required by law.

Payment may be arranged by bank transfer or through a payment link, according to the arrangements agreed with you before purchase.

Unless otherwise agreed in writing, payment must be completed before preparation of your plans begins and before the start date of a coaching programme is confirmed.

If payment is not received, we may postpone the start of the service after notifying you. This does not remove any statutory rights you may have.

We will not impose payment surcharges prohibited by applicable law.

The service, price and payment arrangements will be confirmed before you are committed to the purchase. Where relevant, the programme start date and delivery arrangements will also be confirmed.

8. Preparation and Delivery of Plans

After the service has been agreed and the required payment arrangements have been completed, we review the information you provide through the initial questionnaire and any relevant communications.

We prepare the plans individually and deliver them by email or another electronic method agreed with you.

For personal coaching programmes, the nutrition and exercise plans are prepared before Day 1.

We will explain the expected delivery and commencement arrangements before the programme begins.

You are responsible for checking that you can access the materials and for informing us promptly if you have not received them or cannot open them.

If we anticipate a material delay or cannot provide an agreed part of the service, we will inform you and discuss the appropriate next steps.

Your statutory rights remain unaffected if a service is not delivered as agreed.

9. Personal Coaching and Zoom Sessions

Personal coaching programmes include one 30-minute Zoom session each week for the agreed programme duration.

The first session is scheduled for Day 1. During this session, we discuss your plans and answer your initial questions.

Subsequent sessions are arranged between you and Healing by Nutrition.

The weekly sessions provide dedicated time to discuss your experience, answer questions about the plans and consider practical challenges as you put your plans into practice.

The sessions do not constitute medical consultations or unlimited access to individual support outside the agreed programme.

You are responsible for having a suitable internet connection and the equipment needed to participate in Zoom sessions.

If a technical problem on our side prevents a session from taking place, we will make reasonable efforts to reschedule it or agree on an appropriate alternative.

Nothing in this section excludes any remedy to which you are legally entitled if a service is not provided as agreed.

10. Rescheduling and Missed Sessions

If you need to reschedule a Zoom session, please contact us as early as possible.

We will make reasonable efforts to arrange an alternative time, subject to availability.

If you cannot attend a scheduled session, please inform us promptly.

A missed session does not automatically entitle you to an additional session or an extension of the programme. However, we will consider the circumstances fairly and in accordance with applicable law.

If we need to reschedule a session, we will notify you and arrange an alternative time.

The programme duration does not automatically extend because a client misses a session, delays following a plan or is unable to participate, except where otherwise agreed or required by law.

11. Statutory Right of Withdrawal

If you are a consumer entering into a contract at a distance, for example through our website or by email, you will generally have a statutory right to withdraw from the contract within 14 days without giving a reason, subject to applicable law and any relevant statutory exceptions.

For a service contract, the 14-day period generally begins on the day the contract is concluded.

To exercise your right of withdrawal, you must inform us clearly that you wish to withdraw. You can contact us at support@healingbynutrition.com. You may also use the model withdrawal form at the end of these Terms and Conditions, although you are not required to use that form.

You can also use our Right of Withdrawal page to access the withdrawal procedure and form.

11.1 Requesting the Service to Begin During the Withdrawal Period

If you ask us to begin providing a service during the 14-day withdrawal period, we will obtain your express request where required by law.

If you subsequently withdraw from the contract during that period, you may be required to pay a proportionate amount for the service provided up to the time you informed us of your withdrawal, provided the applicable legal requirements have been satisfied.

You will not be charged for services not provided where the law does not permit such a charge.

11.2 Completion of a Service During the Withdrawal Period

For a service contract, the right of withdrawal is lost after the service has been fully performed only where the applicable legal requirements have been met, including your prior express consent to begin performance and your acknowledgement that you would lose the right once the service had been fully performed.

The fact that a plan is personalised or prepared specifically for you does not, by itself, automatically remove your statutory right of withdrawal.

Where a purchase includes digital content supplied separately from a service, any applicable rules governing withdrawal from digital-content contracts will be explained before purchase, and any required consent or acknowledgement will be obtained.

Where applicable law requires an online withdrawal facility, we will provide the relevant procedure through our website. Any required confirmation of receipt will be provided in a form you can retain.

Nothing in this section restricts any more favourable mandatory consumer rights that apply to your contract.

12. Cancellations and Refunds

Your statutory rights, including any applicable right to withdraw from a distance contract, take precedence over any conflicting provision in these Terms and Conditions.

If you wish to cancel a programme or request a refund, please contact support@healingbynutrition.com and explain your request. You may also use the applicable statutory withdrawal procedure where you are exercising a right of withdrawal.

The following principles apply:

  • If you exercise a statutory right to withdraw, refunds and any permitted payment for services already provided will be handled in accordance with applicable law.

  • If we are unable to provide a service you purchased, we will consider the appropriate remedy, which may include rescheduling, an alternative arrangement or a refund, depending on the circumstances and applicable law.

  • If a service has begun outside the statutory withdrawal period, cancellation and refund requests will be considered under the contract and applicable law.

  • We will not apply a blanket no-refund rule that removes rights guaranteed by mandatory consumer-protection law.

Any refund due under a statutory right of withdrawal will be made within the applicable legal deadline and using the original payment method unless otherwise agreed or required by law.

Nothing in this section limits your rights where a service is faulty, not provided as agreed or otherwise gives rise to a remedy under applicable law.

13. Client Responsibilities

When using our services, you agree to:

  • Provide accurate and relevant information when completing the questionnaire.

  • Inform us of relevant changes to information on which your plans are based.

  • Read the plans and ask questions if any instructions are unclear.

  • Use your own judgement when applying general educational guidance.

  • Exercise within your abilities and stop activities that cause concerning symptoms.

  • Seek qualified professional advice when appropriate.

  • Participate in scheduled coaching sessions as agreed.

  • Treat communications and scheduled sessions respectfully.

You are not required to follow any recommendation you consider unsuitable. If you are uncertain whether a recommendation is appropriate for you, seek advice from a suitably qualified professional.

14. No Guarantee of Results

People differ in their circumstances, preferences, starting points and responses to changes in nutrition and exercise.

We do not guarantee weight loss, changes in body composition, improvements in strength or fitness, symptom relief, disease outcomes or any other specific result.

Any personal experiences described on our website are individual experiences and should not be interpreted as a promise that you will achieve the same results.

Results may depend on factors beyond our control, including your individual circumstances, consistency, health, environment and other influences.

This section does not remove our obligation to provide the services you purchased in accordance with the contract and applicable law.

15. Intellectual Property

Unless otherwise stated, the written plans, documents, website text, graphics and other materials supplied or published by Healing by Nutrition are protected by applicable intellectual-property laws.

After purchasing a service, you may use the materials supplied to you for your own personal use.

Unless we give prior written permission or the law permits it, you may not:

  • Republish or distribute our materials to the public.

  • Sell, rent or sublicense our materials.

  • Reproduce or commercially exploit our materials.

  • Share our personalised plans with others for commercial purposes.

  • Present our original materials as your own work.

Nothing in this section restricts your statutory rights or prevents you from using information in ways permitted by law.

16. Privacy and Confidentiality

We handle personal information in accordance with applicable data-protection law and our separate Privacy Policy.

Information you provide through an enquiry, questionnaire or coaching programme will be used for the purposes explained in that policy.

Please do not send sensitive personal information that is not necessary for the service.

We take reasonable steps to protect programme-related information and limit access to it as appropriate.

The Privacy Policy explains what personal information we collect, the purposes and legal bases for processing, relevant recipients, retention periods and your data-protection rights.

Our confidentiality commitments are subject to applicable legal obligations.

17. Website Content, Cookies and External Links

Our website may contain general educational information and links to external websites.

We aim to keep our website information accurate and up to date. However, general website content may not reflect the latest developments and may not be suitable for every individual circumstance.

Website content is provided for general informational purposes and does not replace individual professional advice.

External websites are operated by third parties. We do not control their content or privacy practices and are not responsible for them to the extent permitted by applicable law.

Cookies and similar technologies are addressed through our cookie notice and, where applicable, our consent mechanism and Privacy Policy. Optional cookies or tracking technologies will be handled in accordance with applicable legal requirements.

Nothing in this section excludes liability that cannot lawfully be excluded.

18. Liability

We are responsible for providing the services in accordance with the contract and applicable law.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

To the extent permitted by law, we are not responsible for consequences arising from inaccurate or incomplete information supplied by a client, undisclosed circumstances relevant to the preparation of a plan, or decisions made without regard to appropriate professional advice.

This section does not exclude or limit liability for fraud, wilful misconduct, negligence or any other liability that cannot lawfully be excluded or limited under applicable law.

Nothing in these Terms and Conditions removes your statutory consumer rights or limits any remedy available to you under mandatory law.

19. Complaints

If you are dissatisfied with a service, please contact us at support@healingbynutrition.com.

Please describe the issue and, where possible, include the relevant programme details and the outcome you are seeking.

We will review your complaint and respond within a reasonable period.

If we cannot resolve the matter directly, you may have the right to use an applicable consumer dispute-resolution procedure or bring a claim before a competent court. Your statutory rights remain unaffected.

20. Changes to These Terms

We may update these Terms and Conditions to reflect changes to our services, business arrangements or legal requirements.

The version applicable to your purchase will be made available to you before you enter into the contract.

Changes to these Terms and Conditions will not retrospectively alter an existing agreement unless permitted by law or agreed with you where agreement is required.

21. Governing Law and Jurisdiction

These Terms and Conditions and any contract between you and Healing by Nutrition are governed by the laws of the Netherlands, subject to any mandatory consumer-protection provisions that apply.

If you are a consumer residing in another country, you may retain the protection of mandatory provisions of the law of your country of habitual residence where the applicable legal rules provide for that protection.

Any dispute arising from these Terms and Conditions or a contract with Healing by Nutrition will be submitted to a court having jurisdiction under applicable law.

Nothing in this section limits any mandatory consumer rights or restricts a consumer's right to bring proceedings before a court where applicable law permits them to do so.

22. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any invalid provision will be interpreted or replaced, where legally possible, in a way that most closely reflects its lawful purpose without reducing mandatory consumer rights.
